Statute Text
Purpose.
It is the
purpose of ORS 97.923 to 97.949, 97.992, 97.994 and 692.180 to ensure funds for
performance to purchasers who contract through prearrangement sales contracts
for the purchase of funeral or cemetery merchandise or services, and through
preconstruction sales contracts for undeveloped interment spaces. It is also
the purpose of ORS 97.923 to 97.949, 97.992, 97.994 and 692.180 to provide for
the certification or registration of entities selling, offering for sale,
administering or providing merchandise or services to fulfill prearrangement
sales contracts and preconstruction sales contracts, the creation and
administration of prearrangement sales contract and preconstruction sales
contract trust funds, the disbursement and allocation of trust funds upon the
certified providers performance of its contractual obligations and the
protection for the purchaser upon the certified providers default. [Formerly
