Statute Text
Commissioner order; injunctive relief.
(1) If the Real Estate Commissioner finds that an owner, developer or other
person is violating any of the provisions of ORS 94.803 and 94.807 to 94.945,
the commissioner may order the person to desist and refrain from violating the
provisions or requirements, or from the further sale of interests in the
timeshare plan.
(2) If the
commissioner finds that a developer or other person is violating, has violated
or is about to violate, any of the provisions of ORS 94.803 and 94.807 to
94.945, the commissioner may bring an action in the circuit court of the county
where the violation or threatened violation has occurred or is about to occur,
or in the county where the person resides or carries on business, in the name
of and on behalf of the people of the State of Oregon against the person
participating in the violation, to enjoin the person from continuing or
engaging in the violation or doing any act in furtherance of the violation, and
to apply for the appointment of a receiver or conservator of the assets of the
defendant if appropriate. [1983 c.530 §45]
