Statute Text
Recording amended governing documents; marketability of title unaffected by
noncompliance.
(1)
An amended governing document must include a reference to the recording index
numbers and the date of recording of prior governing documents.
(2) The county
clerk may charge a fee for recording a governing document or an amendment to a
governing document under ORS 94.572, 94.573, 94.574 or 94.576 according to the
provisions of ORS 205.320 (1)(d).
(3) Title to a
unit, lot or common property in a Class I or Class II planned community created
before January 1, 2002, may not be rendered unmarketable or otherwise affected
by a failure of the planned community to be in compliance with a requirement of
this section or ORS 94.572, 94.573, 94.574 or 94.576. [2017 c.423 §13]
