Statute Text
Proof
where witnesses are dead or absent.
When any grantor is dead, out of this state, or refuses to acknowledge the
deed, and all the subscribing witnesses to the deed are also dead or reside out
of this state, it may be proved before the circuit court, or any judge thereof,
by proving the handwriting of the grantor and of any subscribing witness
thereto.
