Filing
notice of claim of lien; contents of notice; effect of failure to file notice.
(1) A person claiming a lien
created by ORS 87.352 to 87.362 shall file a written notice of claim of lien
not later than 120 days after the lien attaches with the recording officer of
each county where there is situated any land sought to be charged with the
lien.
(2) The notice of
claim of lien required under subsection (1) of this section must be a statement
in writing verified by the oath of the lien claimant, or, in the case of an
electric cooperative or electric utility, by the oath of an authorized agent,
and must contain:
(a) A true
statement of the lien claimants demand, after deducting all just credits and
offsets, for the labor performed or the provisions, materials and equipment
furnished or transported;
(b) The name of
the owner or reputed owner, if known, of the land to be charged with the lien;
(c) The name of
the person by whom the lien claimant was employed or to whom the lien claimant
furnished the provisions, electricity, materials, equipment or nursery stock;
and
(d) A description
of the property to be charged with the lien sufficient for identification.
(3) If the person
entitled to a lien under ORS 87.352 to 87.362 does not file a notice of claim
of lien within the time required by subsection (1) of this section, the person
waives the right of the person to the lien. [1975 c.648 §46]
