Installation of protective devices where railroads intersect at grade.
(1) In any case where the tracks
of two or more railroads cross each other at a common grade in this state, the
railroads, when ordered by the Department of Transportation, shall protect such
crossings by interlocking or other safety devices, under regulations to be
designated by the department, to prevent trains colliding at such crossings. An
order may be issued under this section only after notice to the affected
railroads and a proceeding under ORS chapter 183 initiated by the department on
its own motion or upon application by one of the railroads.
(2) The
department in making such order shall designate the manner of such interlocking
protection, and shall apportion the cost of installing and maintaining the same
between the several railroads, if such railroads are unable to agree upon the
