Hunting or harassing animals from snowmobile or all-terrain vehicle; civil liability; penalty. (1) A person commits the offense of hunting or harassing animals from a snowmobile or an all-terrain vehicle if the person does any of the following: (a) Operates a snowmobile or an all-terrain vehicle in a manner so as to run down, harass, chase or annoy any game animals or birds or domestic animals. (b) Hunts from a snowmobile or an all-terrain vehicle. (2) This section does not apply to: (a) Officers of the State Fish and Wildlife Commission. (b) Persons under contract to the commission in the performance of their official duties. (c) Individuals who have secured a permit from the commission for purposes of research and study. (3) In addition to other penalties provided by this section, operators or owners of a snowmobile or an all-terrain vehicle may be liable as provided under ORS 821.310. (4) The offense described in this section, hunting or harassing animals from a snowmobile or an all-terrain vehicle, is a Class C misdemeanor.
