Operation of recreational vehicle with unsealed disposal system; exemption;
penalty.
(1) A
person commits the offense of operation of a recreational vehicle with unsealed
disposal system if:
(a) The person
has the use, possession or control of any vehicle or structure constructed for
movement on highways;
(b) The vehicle
or structure is equipped with a plumbing, sink or toilet fixture; and
(c) The disposal
system for the vehicle or structure is unsealed or uncapped while the vehicle
or structure is in any way or place of whatever nature open to the use of the
public.
(2) For purposes
of this section, a way or place open to the use of the public includes, but is
not limited to, highways, roads, streets, alleys, lanes, trails, beaches, parks
and recreational use areas owned or operated by the state, a county or local municipality
for use by the general public.
(3) This section
does not apply to disposal systems being discharged into or connected with a
sewage disposal system approved by the Oregon Health Authority.
(4) The offense
described in this section, operation of a recreational vehicle with unsealed
