Suspension or revocation of driving privileges for unsettled judgment.
(1) If a court notifies the
Department of Transportation under this section that a judgment remains
unsettled as described by ORS 809.470, the department must initiate action to
determine whether to suspend or revoke driving privileges under ORS 809.415. A
court shall immediately give the department notice of an unsettled judgment
under this section if:
(a) A judgment of
the type described under ORS 806.040 is rendered against a person by a court of
this state;
(b) The person
fails within 60 days to settle the judgment in the manner required under ORS
809.470; and
(c) The judgment
creditor or the judgment creditors attorney makes a written request for
forwarding to the department a certificate stating the judgment has not been
settled as described in ORS 809.470.
(2) A court that
has given the department notice of an unsettled judgment under this section
shall immediately forward to the department a certificate stating that the
judgment is appropriately settled and describing the judgment and parties
sufficiently for identification if:
(a) The judgment
is settled in the manner required under ORS 809.470; and
(b) The judgment
debtor or the judgment debtors attorney makes a written request for forwarding
to the department a certificate stating the judgment has been settled as
described in ORS 809.470.
(3) The notice
made to the department under this section shall be given by the clerk of the
