Special limited vision condition learner’s permit. (1) A person with a limited vision condition may apply for a special limited vision condition learner’s permit if the person: (a) Is examined by a licensed vision specialist who determines that the person: (A) Has no ocular diagnosis or prognosis that may result in deterioration of the person’s corrected vision below a 20/200 level of visual acuity; (B) Has a visual field of at least 120 degrees horizontally and 80 degrees vertically; and (C) Would be aided by using a bioptic telescopic lens when operating a motor vehicle; (b) Is fitted by the licensed vision specialist with a bioptic telescopic lens mounted on the carrier lens; (c) Submits to the Department of Transportation a report from the licensed vision specialist certifying that the person meets the requirements of this subsection; (d) Submits proof to the department that the person is enrolled in a rehabilitation training program; and (e) Takes the test described under ORS 807.070 (2). (2) The department shall issue a special limited vision condition learner’s permit to a person who meets the requirements of subsection (1) of this section upon application and payment of the fee under ORS 807.370. (3) If the department issues a special limited vision condition learner’s permit to a person under subsection (2) of this section, the department shall send the permit to the rehabilitation training program in which the person is enrolled.
