Disclosure of commercial or financial information prohibited; exception.
(1) Except as provided in
subsection (2) of this section, no officer, agent or employee of an export
trading corporation shall disclose commercial or financial information
concerning an export trading project.
(2) Commercial or
financial information may be disclosed:
(a) In a judicial
proceeding when disclosure is ordered by a court of competent jurisdiction;
(b) With the
consent of the persons whose interests are affected by disclosure;
(c) By an
officer, agent or employee of an export trading corporation acting within the
scope of employment, as prescribed by rules of the board; or
(d) When the
board finds the information would not reasonably be considered confidential,
the export trading corporation has not obliged itself in good faith not to
disclose the information and disclosure is in the public interest. [1983 c.200 §9]
