Statute Text
Distribution rights; service territories.
(1) Notwithstanding any other provision of law, a
consumer-owned utility has exclusive distribution rights, to the extent the
distribution rights are provided by law other than ORS 757.812 to 757.950, and
exclusive responsibility for the performance and oversight of:
(a) The utilitys
distribution system, including the acquisition, construction, financing,
operation and maintenance of distribution facilities; and
(b) Metering,
billing, collection and consumer response functions related to the distribution
of electricity to retail electricity consumers located within the utilitys
service territory.
(2) ORS 757.812
to 757.950 do not:
(a) Diminish or
enlarge the rights of any person under ORS 758.400 to 758.475; or
(b) Affect the
administration or enforcement of ORS 758.400 to 758.475. [2007 c.807 §33]
