Factors to be considered in approving plan; authority to establish plan;
consultation with State Department of Energy.
(1) Approval of utility plans for the curtailment of
load shall be based on the following factors:
(a) The
consistency of the plan with the public health, safety and welfare;
(b) The technical
feasibility of implementation of the plan;
(c) The
effectiveness with which the plan minimizes the impact of any curtailment; and
(d) Consistency
with Oregon energy policies formulated under ORS 469.010 to 469.155, 469.300 to
469.563 and 757.710 and this section.
(2) In the event
of an emergency threatening the health, safety and welfare of the general
public, the Public Utility Commission may on the commissions own motion and
without hearing establish a plan for the curtailment of load by any person
referred to in ORS 757.710. If an emergency is not present, the commission
shall prior to approval hold public hearings with respect to any proposed plan
and give reasonable notice of such hearings.
(3) The
commission shall consult with the Director of the State Department of Energy
