Statute Text
Infrastructure for vehicles powered by renewable natural gas or hydrogen.
(1) As used in this section, natural
gas utility means a natural gas utility regulated by the Public Utility
Commission under this chapter.
(2) The
commission may allow a natural gas utility to recover costs from all retail
natural gas customers for prudent investments in or expenses related to
infrastructure measures that support the adoption and service of alternative
forms of transportation vehicles if the investments or expenses are consistent
with and meet the requirements of subsection (3) of this section. An investment
or expense by a natural gas utility may include an investment in or an expense
related to infrastructure behind the customer meter.
(3) An investment
in or expense related to infrastructure measures that support the adoption and
service of alternative forms of transportation vehicles is a utility service
and a benefit to retail natural gas customers if the investment or expense can
be reasonably anticipated to:
(a) Support the
adoption of alternative vehicles that are powered by renewable natural gas or
hydrogen;
(b) Support
reductions of transportation sector greenhouse gas emissions over time; and
(c) Benefit the natural
gas utility system. Benefits may include, but need not be limited to:
(A) Distribution
or transmission management benefits;
(B) System
efficiencies or other economic values inuring to the benefit of retail natural
gas customers over the long term; or
(C) Revenues to
natural gas utilities from fueling alternative forms of transportation vehicles
to offset utilities fixed costs that may otherwise be charged to retail
natural gas customers. [2021 c.630 §23]
