Requirements for catastrophic plans. (1) As used in this section: (a) “Catastrophic plan” means a health benefit plan that meets the requirements for a catastrophic plan under 42 U.S.C. 18022(e). (b) “Minimum essential coverage” has the meaning given that term in section 5000A(f) of the Internal Revenue Code. (2) A carrier may offer a catastrophic plan only to an individual who: (a) Is under 30 years of age at the beginning of the plan year; or (b) Is exempt from any state or federal penalties imposed for failing to maintain minimum essential coverage during the plan year.
