Requirements for determination of future premium amounts or minimum values.
In the case of policies of life
insurance which provide for determination of future premium amounts by the
insurer on the basis of current estimates of future experience, or policies of
life insurance which are of such a nature that minimum values cannot in the
judgment of the Director of the Department of Consumer and Business Services be
determined by the methods otherwise described in the Standard Nonforfeiture Law
for Life Insurance, the following requirements shall apply:
(1) The director
must be satisfied that the policy benefits are substantially as favorable to
policyholders and insureds as the minimum benefits otherwise required by the
Standard Nonforfeiture Law for Life Insurance;
(2) The director
must be satisfied that the benefits and the pattern of premiums of the policy
are not misleading to prospective policyholders or insureds; and
(3) The cash
surrender values and paid-up nonforfeiture benefits provided by the policy must
not be less than the minimum values and benefits required for the policy as
calculated by a method consistent with the principles of the Standard
Nonforfeiture Law for Life Insurance, as determined under rules issued by the
