Records of licensee; examination. (1) Each surplus lines licensee shall keep a full and true record of each surplus lines insurance contract placed on an Oregon home state risk by or through the licensee as required by ORS 744.068, including a copy of the policy, certificate, cover note or other evidence of insurance showing any of the following items that are applicable: (a) Amount of the insurance and perils insured; (b) Brief description of the property insured and its location; (c) Gross premium charged; (d) Any return premium paid; (e) Rate of premium charged upon the several items of property; (f) Effective date of the contract and the terms thereof; (g) Name and address of the insured; (h) Name and address of the insurer; (i) Amount of tax and other sums to be collected from the insured; and (j) Identity of the producing insurance producer, any confirming correspondence from the insurer or its representative and the application. (2) The record of each contract shall be kept open at all reasonable times to examination by the Director of the Department of Consumer and Business Services without notice for a period not less than five years following termination of the contract.
