Continuance, expiration or reinstatement of certificate of authority. (1) A certificate of authority shall continue in force as long as the insurer is entitled thereto under the Insurance Code and until suspended or revoked by the Director of the Department of Consumer and Business Services, or terminated at the request of the insurer; subject, however, to continuance of the certificate by the insurer each year by: (a) Payment prior to April 1 of the continuation fee established by the director; (b) Due filing by the insurer of its annual statement for the calendar year preceding; (c) Due filing by the insurer of each annual statement supplement; and (d) Payment by the insurer of premium taxes with respect to the preceding calendar year as required by ORS 731.808 to 731.834. (2) A certificate of authority that is not continued by the insurer under subsection (1) of this section expires on the 60th day after the date on which the payment or filing is due. (3) The director promptly shall notify the insurer of impending expiration of its certificate of authority. (4) The director, in the discretion of the director, upon the insurer’s request made not later than the 90th day after expiration, may reinstate a certificate of authority which the insurer has permitted to expire, after the insurer has cured all its failures which resulted in the expiration and has paid the fee for reinstatement established by the director. Otherwise the insurer shall be granted another certificate of authority only after filing application therefor and meeting all other requirements as for an original certificate of authority in this state.
