Statute Text
Evidence of doing business as contractor.
(1) It is prima facie evidence that a person is doing
business as a contractor if:
(a) The person
for that persons own use performs, employs others to perform, or for
compensation and with the intent to sell the structure arranges to have
performed, work described in ORS 701.005 (5); and
(b) Within any
36-month period the person offers for sale two or more newly built structures
on which work described in paragraph (a) of this subsection was performed.
(2) Licensure
under this chapter is prima facie evidence that the licensee conducts a
separate, independent business. [2007 c.114 §3]
