Statute Text
Entitlements of withdrawing partner.
Except as provided in ORS 70.250 to 70.275, upon withdrawal, any withdrawing
partner is entitled to receive any distribution to which the withdrawing
partner is entitled under the partnership agreement. If not otherwise provided
in the partnership agreement, the withdrawing partner also is entitled to
receive, within a reasonable time after withdrawal, the fair value of the
withdrawing partners interest in the limited partnership as of the date of
withdrawal based upon the withdrawing partners right to share in distributions
from the limited partnership. For purposes of this section, the fair value of
the withdrawing partners interest in the limited partnership shall be
determined by assuming that any distribution to which the withdrawing partner
is otherwise entitled by reason of this section has been made. [1985 c.677 §35]
