Suspension or revocation of license; grounds; notice and hearing.
(1) The Director of the Department
of Consumer and Business Services may by order suspend or revoke any license
issued under ORS 697.514 if the director finds that any of the following
circumstances are true:
(a) The licensee
has violated a provision of ORS 697.500 to 697.555 or of a rule or order the
director has adopted or issued under ORS 697.500 to 697.555.
(b) The licensee
knowingly made a false or misleading statement on the application for a license
under ORS 697.510 or in information the licensee submitted to the director.
(c) The licensee
refused to permit the director to make an investigation authorized under ORS
697.528.
(d) The licensee
has engaged in, or has a felony or misdemeanor conviction for, fraud,
misrepresentation or deceit or has demonstrated untrustworthiness or
incompetence in conducting the check-cashing business.
(e) The licensee
has not paid a fee required under ORS 697.512 or examination costs under ORS
697.528.
(2) The director
may not suspend or revoke any license issued under ORS 697.514 unless the
licensee has had notice and an opportunity for a hearing in accordance with ORS
183.413 to 183.470. [2007 c.358 §13]
