Statute Text
Disposal of marijuana item left at retail drug outlet; rules; exemption from
criminal liability.
(1) The State Board of Pharmacy shall establish by rule instructions for the
disposal of a marijuana item as defined in ORS 475C.009 left behind by
individuals visiting retail drug outlets.
(2) At a minimum,
the instructions established under subsection (1) of this section must:
(a) Require an
employee or supervisor of the retail drug outlet to notify law enforcement upon
discovering the marijuana item at the site; and
(b) Include
procedures for destroying the marijuana item so that it can no longer be used
for human consumption.
(3) A person
acting under and in accordance with this section is exempt from the criminal
laws of this state for any criminal offense in which possession of marijuana or
a marijuana item as defined in ORS 475C.009 is an element. [2015 c.614 §131;
