Prohibition on malpractice insurer taking adverse action against health care
provider for specified reasons.
An insurer that provides malpractice insurance for a health care provider for
care provided in this state may not take any adverse action, including but not
limited to sanctions, fines, penalties, rate increases or denial or revocation
of coverage, against a health care provider authorized to provide care in this
state if the adverse action is:
(1) Based solely
on the health care providers providing, authorizing, recommending, aiding,
assisting, referring for or otherwise participating in a reproductive or
gender-affirming health care service that is lawful in this state but unlawful
in the jurisdiction in which the health care provider provided the service, so
long as the service provided was performed in accordance with the standard of
care applicable to the service; or
(2) A result of
an adverse action taken against the health care providers license issued by
another state that resulted solely from the health care providers providing,
authorizing, recommending, aiding, assisting, referring for or otherwise
participating in a reproductive or gender-affirming health care service that is
lawful in this state but provided to a resident of a jurisdiction in which the
service is unlawful or is unlawful in the jurisdiction in which the health care
provider provided the service, so long as the service provided was performed in
accordance with the standard of care applicable to the service. [2023 c.228 §31]
