Statute Text
Giving
false information or making false representations; advertisements.
(1) No employment agency shall
knowingly publish or cause to be published any false, fraudulent or misleading
information, representation, notice or advertisement.
(2)(a) All
advertisements of an employment agency by means of cards, circulars or signs,
and in newspapers and other publications, and all letterheads, receipts and
blanks shall contain the name and address of the office of the employment
agency.
(b) For the
purposes of this subsection, it is sufficient compliance if the name actually
used by the agency in its business is a registered assumed business name or the
name of a bona fide corporation that clearly identifies the agency and the fact
it is an employment agency.
(3) No employment
agency shall knowingly give any false information or make any false promises or
representations concerning an engagement or employment to any person who
registers or applies for employment or help.
(4) Except in an
advertisement in a section of a publication that otherwise clearly designates
the advertisement as that of an employment agency, every employment agency
charging or collecting a fee for services from individuals seeking or obtaining
employment shall use the word agency or agencies as part of its name or
after its name. However, any employment agency that, as its sole means of
procuring or attempting to procure employment or engagements for others, places
the qualifications of applicants before prospective employers in areas exclusively
outside the United States shall not be required to include the word agency or
agencies in its title or in any other identifying materials used in the
