Use of
moneys credited to Unemployment Trust Fund by Secretary of the Treasury.
(1) Money credited to the account
of this state in the Unemployment Trust Fund by the Secretary of the Treasury
of the United States of America pursuant to section 903 of the Social Security
Act, as amended, may be requisitioned and used for the payment of expenses
incurred for the administration of this chapter pursuant to a specific
appropriation by the legislature, provided that the expenses are incurred and
the money is requisitioned after the enactment of an appropriation law which:
(a) Specifies the
purposes for which the money is appropriated and the amounts appropriated
therefor;
(b) Limits the
period within which such money may be obligated to a period ending not more
than two years after the date of the enactment of the appropriation law; and
(c) Limits the
amount which may be obligated under such appropriation at any time to an amount
which does not exceed, at any such time, the amount by which the aggregate of
the amounts transferred to the account of such state pursuant to section 903 of
the Social Security Act, as amended, exceeds the aggregate amount of the
amounts used by the state for administration and charged against the amounts
transferred to the account of such state.
(2) For purposes
of this section, amounts obligated for administrative purposes pursuant to an
appropriation shall be chargeable against transferred amounts at the exact time
the obligation is entered into. The appropriation, obligation, expenditure or other
disposition of money appropriated under this section shall be accounted for in
accordance with standards established by the United States Secretary of Labor.
(3) Money
appropriated as provided in this section for the payment of expenses of
administration shall be requisitioned as needed for the payment of obligations
incurred upon such appropriation, and upon requisition shall be deposited in
the Unemployment Compensation Administration Fund from which such payments
shall be made. Money so deposited shall, until expended, remain a part of the
Unemployment Compensation Trust Fund and, if not expended, shall be returned
promptly to the account of this state in the Unemployment Trust Fund.
(4)
Notwithstanding any other provision of this chapter, money credited to the
account of this state pursuant to section 903 of the Social Security Act, as
amended, and which has been or will be appropriated for administrative expenses
of the Employment Department shall, for the purposes of the computation of fund
adequacy percentage ratio, be deemed a part of the Unemployment Compensation
