Coverage of apprentices, trainees participating in related instruction classes.
(1) All persons registered as
apprentices or trainees and participating in related instruction classes
conducted by a school district, community college district or education service
district in accordance with the requirements of ORS 660.002 to 660.210 or
section 50, title 29, United States Code as of September 13, 1975, are
considered as workers of the school district, community college district or
education service district subject to this chapter.
(2) A school
district, community college district or education service district conducting
related instruction classes shall submit a written statement to the insurer, or
in the case of self-insurers, the Director of the Department of Consumer and
Business Services, that includes a description of the related instruction to be
given to such apprentices or trainees and an estimate of the total number of
persons enrolled.
(3) Upon
receiving the written statement, the insurer, or in the case of self-insurers,
the director, may fix assumed wage rates for those apprentices or trainees
participating in related instruction classes, which may be used only for the
purposes of computations under this chapter.
(4) The State
Apprenticeship and Training Council shall furnish the insurer, or in the case
of self-insurers, the director, and the school district, community college
district or education service district with an estimate of the total number of
apprentices or trainees approved by it for participation in related instruction
classes subject to coverage under this section and any significant changes in
the estimated total. Apprentices and trainees as provided in subsection (1) of
this section are entitled to benefits under this chapter.
(5) The filing of
claims for benefits under the authority of this section is the exclusive remedy
of apprentices or trainees or their beneficiaries for injuries compensable
under this chapter against the state, its political subdivisions, the school
district, community college district or education service district, their
members, officers and employees, or any employer, regardless of negligence.
(6) This section
does not apply to any apprentice or trainee who has earned wages for performing
