Statute Text
Proceedings against unwilling witnesses.
(1) The Director of the Department of Consumer and
Business Services or the Workers Compensation Board, or the authorized
representative or designee of the director or the board before whom testimony
is to be given or produced, in case of the refusal of any witness to attend or
testify or produce any papers as required by subpoena, may report to the
circuit court in the county in which the inquiry, investigation, hearing or
other proceeding is pending, by petition setting forth that due notice has been
given of the time and place of attendance of the witness, or the production of
the papers, and that the witness has been subpoenaed in the manner prescribed
and that the witness has failed and refused to attend or produce the papers
required by the subpoena or has refused to answer questions propounded to the
witness in the course of such proceeding, and ask an order of the court to
compel the witness to attend and testify or produce said papers.
(2) The court,
upon receiving the petition, shall enter an order directing the witness to
appear before the court at a time and place to be fixed in such order, the time
to be not more than 10 days from the date of the order, and then and there show
cause why the witness has not attended and testified or produced the papers.
(3) A copy of the
order shall be served upon the witness.
(4) If it is
apparent to the court that the subpoena was regularly issued, the court shall
thereupon enter an order that the witness appear before the director or the
board or the authorized representative or designee of the director or the board
at a time and place to be fixed in such order, and testify and produce the
required papers and upon failure to obey the order the witness shall be dealt
