Payment of wage claims by receivers, assignees or court; filing statement of
wages due.
(1)
When the property of any company, cooperative association, corporation, firm or
person is seized upon by any process of any court of this state, or when the
business or property is placed in the hands of a receiver, or whenever any
assignment for the benefit of creditors under the laws of this state is made,
then in all such cases the debts owing to laborers or employees, which have
accrued by reason of their labor or employment to an amount not exceeding
$2,000 to each employee for work or labor performed within 90 days next
preceding the seizure or transfer or assignment of such property, or
appointment of said receiver shall be considered and treated as preferred
debts, and such laborers or employees shall be preferred creditors, and shall
first be paid in full, and if there is not sufficient to pay them in full,
their claims shall be paid pro rata, after paying costs.
(2) Any such
laborer or employee desiring to enforce the claim of the laborer or employee
for wages under ORS 652.510 to 652.570 shall present a statement under oath
showing the amount due after allowing all just credits and setoffs, the kind of
work for which said wages are due and when performed, to the officer or person
charged with the execution of said process, within 30 days after the seizure
thereof on any execution or writ of attachment, or to such receiver or assignee
within 45 days after the same may have been placed in the hands of any such
