Statute Text
Construction on public land or right of way or along public watercourse.
(1) The urban flood safety and
water quality district may construct works:
(a) Across or
along any street or public highway, or over any lands, that are the property of
the state or of any political subdivision of the state.
(b) Across or
along any stream of water or watercourse, any ground water resource or any
affected lands that are the property of the state or of any political
subdivision of the state.
(2) When
constructing works under this section, the district shall comply with all
federal, state and local permitting and regulatory requirements and
restrictions applicable to the districts work in a street, right of way,
stream of water or watercourse or ground water resource that is the property of
the state or of any political subdivision of the state. [2019 c.621 §15]
