Amendment of hydroelectric water right or claim; rules; unilateral amendment of
power claim or uncertificated claim to assess project specific fees.
(1) Upon the request of the holder
and the approval of the Water Resources Department, a hydroelectric water right
or claim may be amended.
(2) The Water
Resources Department shall develop rules governing the process by which a
hydroelectric water right or claim may be amended. Any amendments under
subsection (1) of this section shall:
(a) Be consistent
with the final unified state position for the project;
(b) Be consistent
with the requirements of ORS chapter 543A;
(c) Cause no
injury to other water rights; and
(d) Allow for
public participation in the amendment process.
(3) The Water
Resources Director may unilaterally amend a power claim or uncertificated claim
in order to assess project specific fees under ORS 543.080. [1999 c.873 §11]
