Processing project application; fee.
(1) Upon receipt of an application filed as provided in ORS 541.705, the Water
Resources Commission shall determine whether the feasibility study described in
ORS 541.705 for the water development project set forth in or accompanying the
application is satisfactory and if the commission determines that it is not
satisfactory, the commission may:
(a) Reject the
application;
(b) Require the
applicant to submit additional information and revision of the feasibility
study as may be necessary; or
(c) Make such
revisions of the feasibility study as the commission considers necessary to
make the plan satisfactory.
(2) Except as
provided in subsection (3) of this section, the commission shall charge and
collect from the applicant at the time the application is filed a fee of $100.
In addition, the commission shall charge the applicant the amount required to
reimburse the commission for costs that exceed the application fee incurred in
connection with the application. Moneys referred to in this subsection shall be
paid into the Water Development Administration and Bond Sinking Fund.
(3) The
commission may establish by rule an application fee of less than $100 for a
water development project that is for fish protection or for watershed
