Statute Text
relates, threaten the safety of the structure, and the release of water from the structure contrary to the terms, limitations and conditions stated in the order is or may be necessary to remove such threat: (1) The terms, limitations and conditions of the order shall not apply to such release of water. (2) The owner, operator or person in immediate charge of the structure shall immediately notify the commission or the Water Resources Department of the situation. (3) The owner, operator or person in immediate charge of the structure shall immediately notify, to the best of the person’s ability, those persons whose life or property may be threatened by such release of water.
