Statute Text
Cancellation of abandoned water right upon request of owner.
Whenever the owner of a perfected
and developed water right certifies under oath to the Water Resources
Commission that the water right has been abandoned by the owner and that the
owner desires cancellation thereof, the commission shall enter an order canceling
the water right. Effective upon the date of the entering of such order, the
water which was the subject of use under the water right shall revert to the
public and become again the subject of appropriation in the manner provided by
