Statute Text
State or county exempted from prepaying trial fee; recovery of trial fee. When the state or any county is a party to a judicial proceeding in a justice court, the state or county need not pay the trial fee upon demanding a jury, and if the state or county is entitled to recover costs therein, the trial fee shall be allowed and taxed in the state’s or county’s favor as a disbursement, and collected from the adverse party as in ordinary cases.
