Statute Text
Review
of application; additional information.
(1) After the State Department of Geology and Mineral
Industries issues a notice to proceed, the consolidated application shall be
considered complete unless:
(a) New
information is available that could not have been presented at the time of the
completeness hearing; or
(b) Additional
information is necessary to allow the permitting or cooperating agencies to
make a determination regarding whether to issue or deny a permit or to issue
the permit with conditions attached.
(2) The
permitting and cooperating agencies may continue to review an application while
in the process of requesting additional information. However, the department
shall conduct an additional public hearing under ORS 517.977 if the agencies
determine that additional information is significant to the issuance or denial
of a permit. [1991 c.735 §16]
