Counteraffidavits of delinquent owner; suit to quiet title; judgment.
If prior to the issuing of the
certificate there has been filed with the county clerk an affidavit by the
delinquent co-owner that the payment has been made, the clerk shall not issue a
certificate, but the parties shall be left to establish such fact by suit to
quiet the title to the premises. If in the suit it appears either that the
assessment work was not performed by the co-owners claiming to have performed
it, or that the delinquent co-owner has performed or paid the delinquent
co-owners proportion of the assessment work, a judgment shall be entered in
the suit to that effect; but if it is established that the assessment has been
performed by or has been caused to be performed by the co-owners so claiming
and that the delinquent co-owner has not performed or paid the delinquent
co-owners proportion, a judgment shall be entered providing that the co-owners
who performed the assessment work to be the owners of all the interest of the
delinquent co-owner in the premises. The judgment shall be entitled to record
in the Mineral and Mining Record kept by the county clerk in the county, and
shall be indexed in the Mineral and Mining Record for the county. [Amended by
