Statute Text
Unlawful possession of anhydrous ammonia.
(1) A person commits the crime of unlawful possession
of anhydrous ammonia if the person knowingly possesses anhydrous ammonia in a
container that is not approved by the United States Department of
Transportation to hold anhydrous ammonia nor constructed to meet state and
federal health and safety standards to hold anhydrous ammonia.
(2) Unlawful
possession of anhydrous ammonia is a Class A misdemeanor.
(3) This section
does not apply to a person who possesses anhydrous ammonia as part of a
cleanup, as defined in ORS 466.605, of anhydrous ammonia by the Department of
Environmental Quality under ORS 466.610. [2001 c.615 §5]
