Statute Text
Third-party delivery facilitator training program; rules.
(1) A third-party delivery
facilitator shall develop an alcohol delivery training program that includes
training on at least:
(a) Forms of
identification required by ORS 471.130 and methods for identifying, inspecting,
accepting or rejecting identification;
(b) Signs of
visible intoxication and methods for recognizing these signs and for refusing
to deliver alcoholic beverages to a final consumer; and
(c) Rules adopted
by the Oregon Liquor and Cannabis Commission relating to the delivery of
alcoholic beverages to a final consumer.
(2) The
commission may adopt rules regarding the approval of training programs
described in subsection (1) of this section.
(3) In
conjunction with an application for a permit under ORS 471.534, a third-party
delivery facilitator shall submit to the commission a copy of the third-party
delivery facilitators training program for approval by the commission.
(4)(a) A
third-party delivery facilitator shall provide the training program described
in subsection (1) of this section to delivery persons employed by or contracted
with the third-party delivery facilitator, and shall issue to delivery persons
who successfully complete the training program a certificate of completion.
(b) In order to
provide the training program described in subsection (1) of this section, a
third-party delivery facilitator may offer a training program internally or may
contract with another party that offers a training program that is approved by
the commission.
(c) A third-party
delivery facilitator may offer a training program described in subsection (1)
of this section only if the training program is approved by the commission.
(5) A delivery
person may not engage in the delivery of alcoholic beverages unless the
delivery person first completes the training program described in subsection
(1) of this section and holds a certificate of completion described in
subsection (4) of this section. A delivery person who delivers alcoholic
beverages on behalf of more than one third-party delivery facilitator must
complete the training program, and hold a certificate of completion, from each
third-party delivery facilitator on whose behalf the delivery person delivers
alcoholic beverages.
(6) The
commission may adopt rules to carry out this section, including rules to
establish a fee for review and approval of a training program described in
subsection (1) of this section. [2023 c.539 §4]
