Certain cruise ships exempt from liquor laws.
(1) Notwithstanding any provision of this chapter,
the Oregon Liquor and Cannabis Commission may not require the owners, operators
and employees of a cruise ship to have a license or permit issued under the
provisions of this chapter for the purpose of possessing, transporting,
storing, selling or serving alcoholic beverages that are described in
subsection (3) of this section.
(2) The
provisions of ORS 471.740 do not apply to alcoholic beverages that are
described in subsection (3) of this section.
(3) The
provisions of this section apply only to alcoholic beverages that are served
aboard a cruise ship and that are served solely for the purpose of onboard
consumption by a cruise ships passengers, guests, officers and employees.
(4) For the
purposes of this section, cruise ship means a marine vessel used primarily
for nonfishing purposes that is licensed to carry at least 500 passengers,
provides overnight accommodations for those passengers and operates on the
rivers or waterways within the boundaries of the State of Oregon, including
docking and dry docking, fewer than 45 days during a calendar year. [1997 c.256
