Recommendations by state agencies on applications; effect.
Upon receipt of an application for
a hazardous waste disposal site permit, the Department of Environmental Quality
shall cause copies of the application to be sent to affected state agencies,
including the Oregon Health Authority, the Public Utility Commission, the State
Fish and Wildlife Commission and the Water Resources Director. Each agency
shall respond by making a recommendation as to whether the permit application
should be granted. If the Oregon Health Authority recommends against granting
the permit, the Environmental Quality Commission must refuse to issue the
permit. Recommendation from other agencies shall be considered as evidence in
determining whether to grant the permit. [Formerly 459.570; 1987 c.540 §26;
