Statute Text
Where
action to be commenced and tried.
(1) Except as provided in subsections (2) and (3) of this section, all actions
in small claims department shall be commenced and tried in the county in which
the defendants, or one of them, reside or may be found at the commencement of
the action.
(2) When an
action is founded on an alleged tort, it may be commenced either in the county
where the cause of action arose or in the county where the defendants, or one
of them, reside or may be found at the commencement of the action.
(3) When the
defendant has contracted to perform an obligation in a particular county,
action may be commenced either in that county or in the county where the
defendants, or one of them, reside or may be found at the commencement of the
