Civil penalties; rules. (1) Except as provided in subsection (5) of this section, for purposes of imposing civil penalties, residential facilities approved under ORS 443.400 to 443.455 are subject to ORS 441.705 to 441.745. (2)(a) The Director of Human Services shall impose penalties on residential care facilities pursuant to ORS 441.731. (b) The director shall impose penalties pursuant to ORS 427.900 on residential training facilities and residential training homes that are not in compliance with ORS
