Information provided upon admission; designated contact persons. Upon the admission of a resident to a residential care facility: (1) The facility shall provide the resident with information developed by the Long Term Care Ombudsman describing the availability and services of the ombudsman. (2) Unless the resident, the resident’s guardian or the resident’s legal representative chooses not to identify a designated contact person, the facility shall obtain from the resident, the resident’s guardian or the resident’s legal representative the full name, preferred contact information and preferred language of an individual to be contacted when the facility: (a) Is required under ORS 443.441 (7) to provide notice of a substantiated finding of a violation; (b) Is required under ORS 443.875 to provide notice of a substantiated finding of abuse; or (c) Is required under ORS 443.436 to provide notice that the facility has been placed in the enhanced oversight and supervision program. (3) The facility shall immediately update the information provided under subsection (2) of this section upon written notification from the resident, the resident’s guardian or the resident’s legal representative.
