Statute Text
Requirements for interstate compacts.
(1) A compact entered into under ORS 417.095 must contain all of the following:
(a) A provision
making the compact available for joinder by all states.
(b) A provision
for withdrawal from the compact upon written notice to the parties with a
period of one year between the date of the notice and the effective date of the
withdrawal.
(c) A requirement
that, notwithstanding a states withdrawal from the compact, the state shall
continue to provide the protections afforded by the compact for the duration of
any adoption assistance agreement to all children and their adoptive parents
who, on the effective date of the states withdrawal, are receiving adoption
assistance from a state other than the residence state.
(d) A requirement
that:
(A) Each instance
of adoption assistance to which the compact applies be covered by an adoption
assistance agreement;
(B) An adoption
assistance agreement be in writing and signed by the adoptive parents and the
child welfare agency of the state that undertakes to provide the adoption
assistance; and
(C) An adoption
assistance agreement is intended expressly for the benefit of the adopted child
and is enforceable by the adoptive parents and the state agency providing the
adoption assistance.
(2) A compact
entered into under ORS 417.095 may contain:
(a) Provisions
necessary to administer the compact.
(b) Provisions
establishing procedures for and entitlement to medical and necessary social
services for a child when the child and the adoptive parents are living in a
state other than the state responsible for or providing the services or the
funds to pay part or all of the costs of the services. [1999 c.859 §3]
