Priority of special deposit claims.
The owners of special deposit claims against a coordinated care organization
for which a receiver is appointed shall be given priority against their several
special deposits in accordance with the provisions of the statutes governing
the creation and maintenance of the deposits. If there is a deficiency in any
deposit so that claims secured by the deposit are not fully discharged, the
claimants may share in the general assets of the coordinated care organization
after:
(1) The payment
of claims of general creditors; and
(2) Claimants
against other special deposits, who have received smaller percentages from
their respective special deposits, have been paid percentages of their claims
equal to the percentage paid from the special deposit. [2019 c.478 §46]
