Statute Text
Preference of claims. Except as provided in ORS 415.406 for secured claims, the claims to be paid in full in delinquency proceedings against a coordinated care organization prior to the payment of any other claims, and the order of payment, shall be: (1) The expenses of administering the delinquency proceedings; (2) Claims that are legally due and owing by the coordinated care organization to the United States; (3) Compensation or wages owed to employees other than officers of the coordinated care organization, for services rendered within three months prior to the commencement of the delinquency proceeding, but not exceeding $5,000 for each employee; (4) Claims legally due and owed by the coordinated care organization to the state; and (5) Claims, including special deposit claims, owed to any person that by the laws of the state is entitled to priority.
