Liability of person wrongfully receiving payment of public assistance or
medical assistance; amount of recovery; rules.
(1) A person who accepts from the
Department of Human Services or the Oregon Health Authority a payment for
furnishing any need to or for the benefit of a public assistance or medical
assistance recipient is liable to refund or credit the amount of the payment to
the department or the authority if the person has obtained or subsequently
obtains from the recipient or from any source any additional payment for
furnishing the same need. However, the liability of the person is limited to
the lesser of the following amounts:
(a) The amount of
the payment accepted from the department or the authority; or
(b) The amount by
which the aggregate sum of all payments accepted or received by the person
exceeds the maximum amount payable for the need under rules adopted by the
department or the authority.
(2)
Notwithstanding subsection (1) of this section, a person who, after having been
afforded an opportunity for a contested case hearing pursuant to ORS chapter
183, is found to have violated ORS 411.675 is liable to the department or the
authority for treble the amount of the payment received as a result of the
violation.
(3) The
department and the authority may prosecute civil actions to recover moneys
claimed due under this section and for costs and disbursements incurred in such
