Submitting wrongful claim for payment of public assistance or medical
assistance.
A
person may not obtain or attempt to obtain, for personal benefit or the benefit
of another person, a payment for furnishing any need to or for the benefit of a
public assistance or medical assistance recipient by knowingly:
(1) Submitting or
causing to be submitted to the Department of Human Services or the Oregon
Health Authority a false claim for payment;
(2) Submitting or
causing to be submitted to the department or the authority a claim for payment
that already has been submitted for payment unless the claim is clearly labeled
as a duplicate;
(3) Submitting or
causing to be submitted to the department or the authority a claim for payment
that is a claim that already has been paid by any source unless clearly labeled
as already paid; or
(4) Accepting a
payment from the department or the authority for the costs of items or services
that have not been provided to or for the benefit of a public assistance or
