Authorization to establish volunteer program in department; volunteer as agent
of state; rules.
(1) The Director of Human Services is authorized to establish the Department of
Human Services Volunteer Program to assist in carrying out the duties of the
Department of Human Services.
(2) A volunteer
who is performing services pursuant to the Department of Human Services
Volunteer Program established under subsection (1) of this section is an agent
of the state for purposes of ORS 30.260 to 30.300 and is not an agent of local
governments or nonprofit entities that utilize the volunteers services.
However, local government or nonprofit entities are responsible for their own
negligent acts or those of their own officers, employees and agents.
(3) The director
is authorized to adopt all rules necessary to implement and administer the
Department of Human Services Volunteer Program. [1997 c.597 §1; 1999 c.421 §8]
