Statute Text
to submit a traffic impact analysis in conjunction with the application
for an approach permit.
(2) The
department may not require a person applying for an approach permit to submit a
traffic impact analysis when:
(a) The average
daily volume of trips at the property is 400 or fewer trips.
(b) The average
daily volume of trips at the property is more than 400 but fewer than 1,001
trips if:
(A) The highway
is a two-lane highway with fewer than 5,000 motor vehicles in annual average
daily traffic;
(B) The highway
is a three-lane highway with fewer than 15,000 motor vehicles in annual average
daily traffic;
(C) The highway
is a four-lane highway with fewer than 10,000 motor vehicles in annual average
daily traffic; or
(D) The highway
is a five-lane highway with fewer than 25,000 motor vehicles in annual average
daily traffic.
(3) The average
daily trips at a property may be determined using nationally recognized
standards, as adopted by the department by rule.
(4) The number of
motor vehicles in annual average daily traffic for a state highway may be
determined from the most recent edition of the transportation volume tables
published annually by the department. The department shall post the
transportation volume tables on the departments website. [2011 c.330 §18]
